OFFICIAL CONTEST RULES AND REGULATIONS

By participating in the “Enter for a Chance to Win a Snowboard” Contest (the “Contest”), you are signifying your agreement that you have read and agree to be legally bound by these official contest rules and regulations (the “Rules”). The decisions of White Claw Seltzer Co., a division of Mark Anthony Group Inc. (the “Sponsor”) of 100 - 565 Great Northern Way, Vancouver, British Columbia V5T 0H8, with respect to all aspects of the Contest are final and binding.

  1. CONTEST PERIOD. The Contest begins at 12:00:01 am Pacific Time (“PT”) on April 4, 2025 and ends at 11:59:59 pm PT on April 5, 2025 (the “Contest Period”). Entries submitted before or after the Contest Period will not be eligible. Sponsor’s computer or networking equipment is the official time-keeping device for the Contest.
  1. To enter the Contest and be eligible for a chance to win a prize a person (the “Entrant”) must be a legal resident of British Columbia who is at least 19 years old at the time of entry. Persons are not eligible to enter if they: a) are an employee, director, representative, agent or officer of the Sponsor, its parent companies, subsidiaries, affiliates, advertising or promotional agencies, prize suppliers, or any other individual or entity involved in the development, production, administration or fulfillment of the Contest (collectively the “Contest Parties”); b) are an employee of or contractor to any provincial liquor authority or any participating licensed establishment; or c) are a member of the immediate family (defined as parents, siblings, children, spouse and life partner, regardless of where they live) or household (whether related or not) of any of the above-referenced persons.
  1. HOW TO ENTER: No Purchase Necessary. A purchase will not improve your chances of winning. Internet access and an active Instagram account required. Online entry through Instagram only; no other means of submission will be accepted.

 

To enter via Instagram:

  • To enter, you must log in to your Instagram account (or create an account at www.instagram.com) during the Contest Period;
  • Take an original photo of yourself (the “Photo”) at the AltiTunes Music Fest 2025 from April 4 - 5, 2025;
  • Post the Photo on your Instagram account in one of the following formats:
  1. In-Feed Post Entry: Upload the Photo as a post to your Instagram feed, tag (@whiteclawcanada) on the Photo with the post caption containing the hashtag (#ContestEntry)
  2. Story Entry: Share the Photo as an Instagram Story, mention (@whiteclawcanada) and hashtag (#ContestEntry)

    Once you have completed all of the foregoing steps to enter (as determined by the Sponsor in its sole and absolute discretion), you will be eligible to receive an entry (an “Entry”).

    For the purpose of these Rules, “Entry” includes an Entrant’s original submitted photo and any and all associated content, comments and material(s) (collectively, “Entry Materials”).

    Entries: To be eligible, all Entry Materials associated with your Entry must: (i) be publicly shared; (ii) not be deleted or altered during the Contest Period and with respect to Story Entries, must not be deleted within 24 hours of submission; (iii) be submitted and received in accordance with these Rules during the Contest Period; (iv) include all required Entry Materials, including required components/elements required in Rule 3; (v) be in accordance and compliant with these Rules, including, but not limited to, the specific Participation Requirements listed below in Rule 4; (vi) be in accordance and compliant with the applicable terms, rules, policies and guidelines of Instagram (the “Instagram Rules”), and (vii) be written in English and relate to the Post (for Instagram) (all as determined by Sponsor in its sole and absolute discretion).

    Entry Limit: For clarity, a single Photo may be submitted as one (1) In-Feed Post Entry and one (1) Story Entry, allowing for a total of two (2) entries per Photo. You may submit multiple Entries into the Contest, provided that each Entry is accompanied by an original Photo that has not been previously submitted. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; (ii) use multiple names, identities, e-mail addresses, and/or Instagram accounts; (iii) use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; and/or (iv) disrupt or participate in the Contest in any other fraudulent, abusive, deceptive, unfair or misleading way; then the Entrant may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. An Entry may be rejected if (in the sole and absolute discretion of the Sponsor): (i) the Entry is not submitted and received in accordance with these Rules or Instagram Rules during the Contest Period; and/or (ii) the Entry is not otherwise in compliance with these Rules or Instagram Rules (all as determined by Sponsor in its sole and absolute discretion).

    Standard message and data rates may apply to participants who choose to participate in the Contest through a mobile device or other electronic devices. Please contact your service provider for pricing and service plan information and rates before any mobile or electronic device participation.
  1. PARTICIPATION REQUIREMENTS AND LICENSE. By participating in the Contest, each Entrant hereby warrants and represents that any Entry Materials submitted:
  • Do not refer to, include, or promote any form of alcohol consumption (e.g. bottles and glasses must be full and of legal serving size) or any form of irresponsible or illegal immoderate use of alcohol;
  • Do not depict venues where consumption is prohibited (such as public places);
  • Are not targeted at or likely to appeal to an audience under the legal drinking age;
  • Do not contain any reference to or likeness of any identifiable third parties if they are under the legal drinking age in their jurisdiction of residence;
  • Do not contain any reference to or any image/likeness/voice of any identifiable third parties, unless consent has been obtained from all such individuals; if your entry does contain the likeness of any third party(ies), you represent and warrant to the Sponsor that you have obtained all necessary rights from all such persons to share their image online as part of your participation in the Contest and you agree to indemnify and hold harmless the Sponsor from and against any and all claims related, directly or indirectly, to your submission including, without limitation, claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property-related or other cause of action.
  • Do not associate consumption of liquor with driving a motorized vehicle, or with any activity that requires care and skill or has elements of danger;
  • Do not suggest any illegal sale, illegal purchase, illegal gift, illegal handling or illegal consumption of liquor;
  • Do not endorse, condone and/or discuss any illegal, inappropriate or risky behaviour or conduct;
  • Do not refer to, include, or promote any behaviour which may be considered antisocial, illegal or immoral;
  • Are original to him/her and that the Entrant has obtained all necessary rights in and to the Entry for the purposes of entering such Entry Materials in the Contest;
  • Have not been used for another Contest;
  • Do not and will not violate any law, statute, ordinance or regulation;
  • Will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party (including, without limitation, any competitors of Sponsor), or give rise to any claims for payment whatsoever; and
  • Are not defamatory, trade libelous, offensive, hateful, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:

- Alcohol/drug consumption or smoking;

- Nudity;

- Sexual activity or content;

- Violence;

- Crude, vulgar or offensive language and/or symbols;

- Derogatory characterizations of any ethnic, racial, sexual or religious groups;

- Content that endorses, condones or discusses any illegal, inappropriate or risky activity, behaviour or conduct;

- Personal information of individuals, including without limitation, names and addresses (physical or e-mail);

- Conduct or other activities in violation of these Rules;

- Commercial messages, comparisons or solicitations for products or services;

- Any identifiable third-party products and/or trade-marks, brands or logos. For example, any clothing worn by persons appearing in an Entry must not contain any visible logos, trade-marks or other third party materials;

- URLs or links to any third party websites; and

- Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor and/or the contest judges in their sole and exclusive discretion.

    The Sponsor or designated content moderator (collectively, the “Reviewer”) reserves the right to screen all Entry Materials. Any Entry Materials that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules are subject to disqualification. The Reviewer reserves the right, in its sole and absolute discretion at any time and for any reason, to request an Entrant to modify, edit and/or re-submit his or her Entry Materials (or any part thereof) in order to ensure that the Entry Materials comply with these Rules, or for any other reason. If such an action is necessary at any point during or after the Contest, then the Sponsor reserves the right, in its sole and absolute discretion, to take whatever action it deems necessary based on the circumstances – including, without limitation, disqualifying the Entry Materials (and therefore the corresponding Entry and/or the associated Entrant) – to ensure that the Contest is being conducted in accordance with the letter and spirit of these Rules.

    By entering the Contest and submitting an Entry, each Entrant: (i) without limiting the Instagram Rules, grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use their Entry Materials (and each component thereof), in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to their Entry Materials (and each component thereof) in favour of the Sponsor (and anyone authorized by the Sponsor to use such Entry Materials); and (iii) agrees to release and hold harmless the Released Parties (as defined below in Rule 8) from and against any and all claims, damages, liabilities, costs, and expenses arising from use of their Entry Materials (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property-related or other cause of action whatsoever.

 

  1. Alcohol is not part of the prize. There will be one (1) Prize (the “Prize”). The Prize consists of: White Claw Branded Snowboard. The Prize is provided by the Sponsor. The approximate retail value (“ARV”) of the Prize is six hundred Canadian dollars ($600 CAD).

    There is a limit of one (1) Prize per person. No more than the advertised number of prizes will be awarded. The Prize will only be released to the verified winner. Arrangements for Prize delivery will be confirmed with the potential winner by e-mail, telephone or Instagram (direct message or tagged post). Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner.

    Without limiting the foregoing, the following terms and conditions apply to the Prize, as applicable: (i) Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash, another prize or otherwise (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at Sponsor's option; (iii) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the potential winner, including without limitation, airline baggage fees, gratuities, meals, transportation, personal expenses of any kind or nature, federal, provincial and local taxes, room taxes and other hotel fees, charges and/or fees arising from changes, and any other incidental costs or expenses; (iv) if the potential winner (and as applicable, their guest(s)) does not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (v) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor's sole and absolute discretion, a cash award; (vi) neither Sponsor nor any of its prize providers will replace any lost, stolen or destroyed tickets, gift cards, promotional cards or vouchers; (vii) any difference between the actual value of a Prize and its stated ARV will not be awarded (including, as applicable and without limitation, the point of departure and fluctuations in the cost of air transportation); (viii) Prize may not be exactly as shown in promotional materials; (ix) by accepting the Prize, the potential winner (and as applicable, their guest(s)) agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part; (x) if the Prize includes guest(s), guest(s) must be at least 19 years of age; and (xi) by participating in a Prize or any portion thereof, the potential winner (and as applicable, their guest(s)): (a) signifies that they understand, acknowledge and accept that participation in the Prize may involve danger and/or exposure to risks and hazards (including without limitation as may be due to the inherent risks of travel and as may be due to possible COVID-19 exposure or infection), whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, they may suffer damage to personal property, serious personal injury, illness or even death; (b) signifies that they acknowledge and agrees that the Released Parties (as defined below) have not made any warranties, guarantees or representations about their safety while participating in the Prize.

    The Released Parties (as defined below) are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason (including, without limitation, due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate COVID-19 transmission, or due to any other cause of any kind or nature whatsoever), of any aspect of the Prize. Neither the potential winner (and as applicable, their guest(s)) nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein. The potential winner (and as applicable, their guest(s)) will be solely responsible for complying with any and all COVID related and other protocols – including, but not limited to, mandatory vaccination, testing and/or screening requirements.

    None of the Released Parties (as defined below) makes any representation or offers any guarantee or warranty, express or implied, in fact or in law, as to the quality, authenticity, merchantability, mechanical condition or fitness of any prizes awarded in connection with the Contest. To the fullest extent permitted by applicable law, the potential winner understands and acknowledges that they may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should the Prize fail to be fit for its purpose or is in any way unsatisfactory.

    By entering this Contest and accepting the Prize, the potential winner agrees to maintain their (and as applicable, their guest(s)) behaviour in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest-related or Prize-related activity. The potential winner understands and agrees that Sponsor, or prize providers have the right, in their sole discretion, to disqualify and remove the potential winner (and as applicable, their guest(s)) from any activity at any time if the potential winner (and as applicable, theirs guest(s)) behaviour at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of any Contest-related party or otherwise violates the policies of the prize providers, and in such a case, the potential winner will still be solely responsible for all expenses related to the Prize.

 

  1. WINNER SELECTION: A random draw will be conducted from all eligible Entries submitted and received in accordance with these Rules during the Contest Period to select one (1) eligible entrant on or around April 7, 2025 (the “Selection Date”) at 100 - 565 Great Northern Way, Vancouver, British Columbia V5T 0H8 by the Sponsor or its designated representative(s), and such selected entrant(s) will be deemed the potential winner(s).

    The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules during the Contest Period.
  1. WINNER NOTIFICATION PROCESS. The Sponsor or its designated representative will make a minimum of three (3) attempts to contact the potential winner (using the information provided at the time of entry) within three (3) business days of the Selection Date. If the potential winner cannot be contacted within three (3) business days of the Selection Date, or if there is a return of any notification as undeliverable; then the potential winner may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential winner following the same winner selection procedure described above (with the necessary amendments), in which case the foregoing provisions of this section shall apply to such new potential winner. No communication will be entered into by the Sponsor with entrants except with selected entrants. The Sponsor is not responsible for the failure, for any reason whatsoever, of a selected entrant to receive notification or for the Sponsor to receive a selected entrant’s response.
  1. WINNER CONFIRMATION PROCESS. BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, the potential winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by e-mail or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Contest Parties and each of their respective successors and assigns, any provincial liquor authorities and any participating licensed establishments (collectively, the “Released Parties”) from any and all liability, directly or indirectly, in connection with this Contest, including without limitation use of the potential winner’s Contest-related information (or any portion thereof), their participation therein, the awarding, receipt, possession or use/misuse of the Prize or any portion thereof, and/or their violation or infringement of any intellectual property rights or of any publicity, personality or privacy rights, or infringe on any rights and/or interests of any third party; and (iv) agrees to the publication, reproduction and/or other use of the potential winner's name or other likeness without further notice or compensation, in perpetuity throughout the world, in any publicity or advertisement carried out by or on behalf of the Sponsor. This release shall continue in force following the termination of the Contest and/or awarding of any prize. Where applicable, potential winner’s guest(s) may also, at the discretion of the Sponsor, be required to properly execute Contest documents within the specified time as a condition of participation in a Prize or any portion thereof, and such release shall continue in force following the termination of the Contest and/or the guest(s) participation in a Prize or any portion thereof, and such release shall continue in force following the termination of the Contest and/or the guest(s) participation in a Prize or any portion thereof.

    If a potential winner: (a) fails to return the properly executed Contest documents within the specified time; (b) fails to correctly answer the skill-testing question; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; (d) at any stage supplied untruthful, incomplete, inaccurate or misleading information (as determined by the Sponsor in its sole and absolute discretion); and/or (e) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then the potential winner will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate potential winner in accordance with the winner selection procedure described above (in which case the foregoing provisions of this section shall apply to such newly selected potential winner).

 

GENERAL RULES

  1. The provincial liquor agencies are not in any way associated with this Contest nor are they liable in any way whatsoever in regard to any matter which relates to this Contest.
  1. The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. You understand that you are providing your information to the Sponsor and not to Instagram. The information you provide will only be used to administer the Contest in accordance with the Sponsor’s privacy policy. Instagram is completely released of all liability by each Entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Instagram.
  1. The Contest is governed by the laws of Canada and the Province of British Columbia and each Entrant in the Contest hereby consents to the exclusive jurisdiction of the laws of British Columbia for any causes or controversies arising out of the Contest. Each Entrant waives any and all objections to jurisdiction and venue in these courts.
  1. All Entries become the property of the Sponsor. This Contest is void where prohibited and is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
  1. By entering this Contest, each Entrant agrees to abide by and be bound by these Rules and to save and hold harmless the Sponsor and the other Released Parties from any and all liability for harm which the potential winner may suffer as a result of participation in the Contest, compliance or non-compliance with these Rules and acceptance, use or misuse of the Prize, and each selected potential winner agrees to sign the Sponsor's declaration and release documents (see Rule 8 above) in this regard before receiving their Prize. The Released Parties shall not bear any liability arising from or in any way relating to the Contest or the Prize awarded.
  1. All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Contest; (ii) for the purposes of verifying the accuracy and/or legitimacy of any Entry, or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.
  1. Entries may not be given or sold to anyone else, and the Sponsor reserves the right to refuse to accept the registration of an entry if the Sponsor considers the entry to have been submitted by an ineligible person or through the use of any automated, macro, script, robotic or other system(s) or program(s). All Entrants must prove their eligibility with valid photo identification and proof of residency, upon request.
  1. In the event of a dispute regarding who submitted an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to require any individual who purports to be the entrant that submitted the Entry in question to provide proof to the complete satisfaction of the Sponsor (as determined by the Sponsor in its sole and absolute discretion) of being the entrant that submitted such Entry. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification (as determined by the Sponsor in its sole and absolute discretion).
  1. Sponsor reserves the right, at its sole and absolute discretion to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure, and if applicable, subject to approval from any provincial liquor authority. The Sponsor, at its sole and absolute discretion reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the foregoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. The Sponsor reserves the right, at its sole and absolute discretion to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
  1. No responsibility is assumed by the Sponsor and the other Released Parties for any inability of a potential entrant to successfully enter the contest for any reason. The Released Parties will not be liable for: (i) any failure of any website during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above. Without limiting the generality of the foregoing, by participating in the Contest, each entrant releases the Released Parties from any and all liability in connection with this Contest and their participation therein.
  1. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
  1. By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with their Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: https://ca.whiteclaw.com/privacy/).This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.
  1. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Website, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law, unless otherwise determined by the Sponsor, in its sole and absolute discretion.
  1. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision.
